Alternative Dispute Resolution
Mediation is an opportunity for the parties to participate in crafting a resolution to the dispute, absent litigation. The mediator facilitates the communications, creating an environment where the parties can acknowledge and understand the dynamics of the dispute. Parties are encouraged to consider compromises and options that could lead to a mutual agreement. The mediator cannot impose their judgement on the parties, the dispute, or the resolution. Nor can the mediator provide legal advice.
Arbitration is an informal forum much like a hearing before a judge. Parties give their statements before the arbitrator and offer supporting evidence. Prior to the arbitration the parties will agree whether the arbitrator’s decision will be binding or no-binding as it relates to the dispute.
Training is conducted on site or via Zoom. Participants’ awareness of the cause of conflict and the psychological and physical components of conflict is the training’s objective. With this awareness participants can employ skills to negate or de-escalate the conflict and, when needed, salvage important relationships.
